(AP) ? The Stone Temple Pilots have fired singer Scott Weiland (WY'-land).

In a one-sentence news release Wednesday, publicist Kymm Britton said: "Stone Temple Pilots have announced they have officially terminated Scott Weiland." No other information was provided.

The Associated Press was attempting to reach Weiland for comment.

The band's 1992 debut, "Core," has sold more than 8 million units in the United States. Their hits include "Vasoline," ''Interstate Love Song" and "Plush," which won a Grammy in 1993 for best hard rock performance with vocal.

Weiland was also in the supergroup Velvet Revolver with Slash and other musicians. The 45-year-old has dealt with drug addiction, run-ins with the law and two failed marriages. He released his memoir, "Not Dead & Not for Sale," in 2011.

The Stone Temple Pilots' latest album is their self-titled 2010 release.

Challenges in Simulating a Human Brain

The human brain is beautifully complex. And frustrating. Our understanding of it is fragmented, and hindered because, except rarely, we can?t get inside and look around while it is still functioning. Computers offer promise; if we could build an artificial brain that behaves likes a real one, maybe we could pick it apart to see how it works. This is the concept behind the Human Brain Project, recently awarded 1 billion euros by the European Commission as one of two Future and Emerging Technologies Flagships Initiatives. HBP?s co-director, Dr. Henry Markram, says they can realistically simulate a human brain within 10 years. But many neuroscientists argue we don?t know enough about the brain to model it. Where are the gaps in our knowledge and why might they present problems?

Constructing the building blocks

An artificial brain must start with good building blocks. Real neurons are diverse. They extend short and long processes, which branch out in different patterns. These shapes are not just for show; neurons process signals differently depending on their structure. One of HBP?s goals is to model neurons as 3-dimensionally detailed cells.

Neurons can be visualized under microscopes and reconstructed using computer programs. But the structure we can recreate in models is an approximation of the real one. It is difficult to mathematically represent all branches, or their turns and tapers. A greater challenge is ascribing functional properties. In many neurons, it is not clear exactly where in the structure signals from other cells are received, or how signals arriving in different branches are combined.

Neurons are also not static. Their extensions reach out or retract due to development, learning, and injury. Knowledge of how this happens is incomplete. How will modelers decide what rules to implement?

The building blocks of an artificial brain must also respond and send signals. Real neurons are populated with many different proteins. For example, channel proteins allow charged molecules, ions, to cross the membrane and generate electrical activity. While many types of ion channel have been characterized, many remain to be studied. In most neurons, the complete population of proteins present, or how they all contribute to signaling, is not known. The number and type of proteins in a neuron also changes under a variety of conditions and the mechanisms are poorly understood. Which proteins should be put into different model neurons? And when should protein expression be turned on, off, up, or down?

Finally, where should proteins be placed? Some channels are present only in cell bodies, while others are found in the extensions. The distribution of channels affects the way neurons receive and sends signals, but often isn?t known. How will morphology be coupled with function?

Building small networks

If challenges in modeling single neurons are overcome, the next step is to connect them. Communication between neurons occurs at specialized contacts. We know a lot about the composition of these contacts and the general rules of signal transmission. But important details are missing. Who is connected to whom? Where in single neurons are contacts located? What are the strengths of the connections, and how do strengths change under different conditions? For most neurons, we have limited information, such as potential partners and estimates of connection strengths. Testing all possible pairs of neurons, even within a small region of brain, is not feasible. How will we connect a network of neurons and be sure that the partners, locations, and strengths are correct? Even if the model is built such that connections and strengths can evolve, what will be the rules of evolution? These details will have profound effects on the model?s output.

Many networks must be connected to form a complete brain. Although we know in general terms which brain regions talk to others, we are ignorant as to many of the details of this communication. Which neurons in which regions are connected? What are the feedback loops by which signals travels from one region to another and back again? It is also not clear how information across multiple levels of organization (molecular, cellular) and processed over multiple time scales (seconds, minutes) is integrated. How should the model be bound together?

What will a model brain do?

If all these challenges are surmounted and a human brain simulated, what might the model do? Will it reproduce behaviors that so impress us about real brains? It?s possible. Beyond a certain level of complexity, a model can do many impressive things. But the focus should be on whether we will understand how and why behaviors emerge. We want mechanisms.

The advantage of a model is that the pieces comprising it are known, and if it is sufficiently simple, pieces can be removed to examine their role. But with the level of complexity required for the proposed model, removing one component at a time would not only be extremely cumbersome, it is questionable whether it would increase our understanding. Complex behaviors, if they arise, will likely result from the interaction of many model components. Could we test all the potential contributing interactions?

Building understanding

HBP researchers are right: we cannot continue to study tiny pieces of the brain in isolation and hope to understand how it works. Their goal to integrate information from experiments and computer modeling is a good one. But we must build upon a solid foundation of knowledge. Markram and associated researchers have spent
the last two decades characterizing cells and mapping connections within cortex. The foundation is growing. Yet, large gaps remain. Will they be fatal to the project? Or, will HBP, as proposed, help us fill them? Neuroscientists will have to wait and see.

mike-proulx-laughThe Internet didn?t kill TV! According to Mike Proulx, the Internet has become TV?s best friend. Proulx will be the opening keynote speaker at SES New York 2013. The leading event for experienced marketing and advertising professionals will take place March 25-28, 2013, at the New York Marriott Marquis.

Proulx is a Senior Vice President and the Director of Social Media at Hill Holliday, a renowned advertising agency based in Boston, where he leads a team with a focus on cross-channel integration, emerging and social media. Search Engine Watch (SEW) asked Mike Proulx (MP) five questions about his upcoming keynote. Here are his answers:

SEW: How does the convergence of television with the web, social media, and mobile change our behaviors and shake up our long standing beliefs about TV?

MP: There are those who believe that television is a traditional medium with an impending death. The web, social media, and mobile have evolved TV into a multi-screen experience that transcends devices. Not only are we watching more television than ever before, we?re interacting with programming on the ?second screen? in ways that enrich storylines and bring us together to virtually co-view. The modern era of television is a new media that?s more social, more connected, and more portable?and because of this TV is more alive than it?s ever been.

SEW: How has social media created a new and powerful "backchannel" and why does this fuel the renaissance of live broadcasts?

MP: There are a ton of posts happening in social media about any given TV show as it airs. Since Twitter is open and public, it acts as television?s backchannel filled with real-time commentary and conversation ? And it?s not just about TV series but also TV commercials giving producers and marketers instant feedback about their content. Live television events are seeing some of the highest ratings in years and social media brings a level of community and connection to TV watching the likes of which the medium has never before experienced.

SEW: Can you give us some examples of how mobile devices allow us to watch and interact with television whenever and wherever we want?

MP: Tablets, smartphones, and laptops enable television?s portability but it?s apps like HBO Go, ABC Player, Xfinity Remote, and CNN that deliver ?TV? content via those devices. And in the 4G world of mobile, we can watch TV in places once inconceivable. My favorite spot? Laying out on the roof deck on a warm summer night with my iPad in hand streaming HBO?s The Newsroom.

SEW: Why would ?connected TVs? blend web and television content into a unified big screen experience that will bring us back into our living rooms?

MP: Apple TV, Roku, Boxee TV, Google TV, Samsung Smart TVs, etc. stream online video (that was once relegated to our computer screens) onto the ?big screen? of our living rooms. HD YouTube clips suddenly come to life in ways that are far more impactful and dynamic than tiny smartphone screens further blurring the lines of what?s ?TV.? While the notion of TV everywhere lets us watch TV at will regardless of our physical location, the increasingly seamless ability to channel streaming video through the TV set makes the living room that much more compelling.

SEW: With the television landscape changing, why should brands approach the medium once labeled ?traditional? as new media?

MP: TV has become mashed up with the Web, social media, and mobile. Television networks, providers, brands, and agencies must continue to unshackle themselves from dated business and advertising models and rediscover television as a new medium. This means planning television and digital together to tell stories across devices and engage viewers with TV experiences not just TV shows. The speed, scale, and degree of change that has and is happening create enormous opportunity for those brands who have the courage to innovate.

Three killed, seven injured in Swiss workplace shooting

MENZNAU, Switzerland (Reuters) - A Swiss factory worker shot two colleagues dead and injured seven more on Wednesday at a wood processing plant near the city of Lucerne, police said.

The shooting was already over and the killer was dead by the time police arrived at the scene. Five of the injured were in a serious condition.

Lucerne police chief Daniel Bussmann told a news conference the 42-year-old attacker had worked at the factory in the town of Menznau, west of Lucerne, for 10 years, but said the motive for the attack was not clear.

A prosecution spokesman said the shooting took place over two to three minutes, with the dead and injured found on the factory floor, in a corridor and the site canteen.

Police did not immediately confirm how the gunman had died.

Mauro Caprozzo, chief executive of the wood processing company Kronoswiss, denied rumors that job cuts were due to be announced at the factory on Wednesday.

He said the killer was a quiet, unassuming character.

"One almost didn't see or notice him," Caprozzo said.

A gunman killed three women and injured two men last month in the Swiss village of Daillon, stirring a debate about Switzerland's firearm laws that allow men to keep guns after their mandatory military service.

There is no national gun register in Switzerland but some estimates indicate that at least one in every three of the country's 8 million inhabitants keeps a gun, many stored at home. Citizens outside the military can apply for a permit to purchase up to three weapons from the age of 18 in a country where sharp shooting and hunting are popular sports.

A shooting in the Zug regional parliament in 2001, in which 14 people were killed, prompted calls to tighten the law, but the majority of Swiss citizens rejected a proposal in 2011 for extra measures such as lock-ups for guns outside service periods.

Afghan president orders US troops out of volatile province on Kabul's flank

President Hamid Karzai has asked US Special Forces to leave Wardak Province, raising concerns about how security might be affected in Afghanistan's capital city.

The Afghan government has demanded that US Special Forces leave a strategic province that lies just to the west of Kabul, claiming in a written statement that American soldiers operating in the region have been ?torturing and even murdering innocent people.? The US-led coalition denies the claims.

The Afghan government?s announcement, which was made on Sunday, ordered Special Forces from the United States ? but not necessarily other countries ? to immediately cease operations in Wardak Province and to entirely?leave the area within two weeks.

In a press conference following the release of the statement, Aimal Faizi, the spokesman for Afghan President Hamid Karzai, suggested that Afghan nationals working with US Special Forces were thought to have committed the violent acts against civilians, not necessarily American soldiers themselves. But the order for US Special Forces to withdraw from Wardak remains intact.

Given Wardak?s proximity to Kabul, the prospect of an American departure from the province has raised concern about how security might be affected in the capital city. Just hours before the Afghan government?s announcement Sunday, Afghan security forces shot dead a suicide bomber who was targeting an intelligence agency office located in Kabul?s diplomatic quarter. Coordinated suicide bombs in two other eastern cities killed three and injured seven within hours of the foiled Kabul attack.

?This decision will have a huge impact on the security situation in Kabul,? says Waliullah Rahmani, a security analyst with the Kabul Center for Strategic Studies. ?Wardak is one of the most volatile provinces. It is a center for the insurgency, which is mainly focused on Kabul.... I don't know why the Afghan president has come to reach such a risky decision.?

The Afghan government cited two examples of alleged abuses by US Special Forces, including one in which nine people ?were disappeared? and another in which a student was taken from his home and found dead two days later, his throat slit. Such episodes have generated ?resentment and hatred? among the people living in Wardak Province, a government statement said.

Coalition disputes claims

The US-led coalition says that such claims are unfounded.

?We looked into the allegations and found no supporting evidence for them,? Brig. Gen. G?nter Katz, a spokesman for the International Security Assistance Force (ISAF), told a press conference in Kabul on Monday morning.

?Afghan officials and ISAF officials are planning talks to discuss the allegations of wrongdoing that were announced yesterday,? he added. ?ISAF takes all allegations of misconduct seriously.??

Wardak Province is a mountainous region whose eastern border lies just 25 miles to the west of Kabul. The province has been the scene of a number of insurgent attacks since the Taliban gained control of Wardak?s remote Tangi Valley nearly two years ago.

The Taliban shot down a US military helicopter in Wardak in August 2011, killing 38 US and Afghan soldiers. An American woman and her Canadian husband disappeared from the region in October of last year; they haven?t been heard from since.?

Whether or not US Special Forces leave Wardak within two weeks, they will almost certainly be out of the province by the end of 2014, in accordance with international plans to withdraw foreign troops and allow Afghan forces to take control of the country?s security.

Speaking to reporters on Monday, Brigadier General Katz stressed that those plans are still moving ahead.

?The [Afghan National Security Forces] are doing very well in pressuring the insurgency,? Katz said. ?The transition process is very well on track and the Afghans are fighting well.?

To the people of Wardak, the transition may not come soon enough.

?The US Special Forces have made things more dangerous here,? Saeed Hashem, a pharmacist, said by phone from Wardak, adding that many people in the region are afraid to leave their houses for fear of potential attacks. ?The Afghan forces should take over control,? he said. ?When that happens, we will be able to defeat the Taliban and the other enemy groups, and Wardak will be safe.?

(AP) ? More than a decade after online file swapping tipped the music industry into turmoil, record executives may finally be getting a sliver of good news.

Industry revenue is up. A measly 0.3 percent, but it's still up.

"For the global music business, it is hard to remember a year that has begun with such a palpable buzz in the air," said Frances Moore, whose International Federation of the Phonographic Industry put together the figures released Tuesday.

"These are hard-won successes for an industry that has innovated, battled and transformed itself over a decade," she said in a statement. "They show the music industry has adapted to the Internet world."

That adaptation has been a long time coming. Online song sharing popularized by services such as Napster at the turn of the millennium seriously destabilized the industry, which reacted with a barrage of lawsuits and lobbying. But the war on piracy failed to stem the tide of free music, and by the time executives finally began making legal music available through download services such as Apple Inc.'s iTunes, the industry was in a free fall.

Since its 1999 peak, the global music industry's revenues have crashed more than 40 percent. Tuesday's figures, which show a rise in global revenue from $16.4 billion in 2011 to $16.5 billion in 2012, are the first hint of growth in more than a decade.

Mark Mulligan, of U.K.-based MIDiA consulting, warned that Tuesday's figures did not mean the industry had put its misery years behind it.

"We're probably near the bottom," he said, "but it's so marginal we could easily have another year or two where it could get worse."

The physical music market continues to contract, losing another $500 million in revenue between 2011 and 2012, according to Tuesday's IFPI figures. The industry group has placed its bets on downloads, streaming, and subscription services to make up for lost ground, but there's still a long way to go.

Downloads and streaming audio now account for most of the music sold in the United States and Scandinavia, but physical music ? everything from vinyl records to DVDs ? still accounts for the majority of industry revenue worldwide.

Mulligan said he believed some of the lost revenue may never be recovered, with many casual users who used to buy the odd CD turning to free services such as YouTube, television music channels, or Internet radio instead.

"This is a case of managed decline," he said, predicting "a sustainable but smaller market built around more engaged music fans."

PHILADELPHIA, Feb. 23 (UPI) -- Dwyane Wade was deadly accurate Saturday, sinking 14-of-18 shots from the field on his way to 33 points in the Miami Heat's 114-90 win over Philadelphia.

LeBron James turned in a triple-double of 16 points, 10 rebounds and 11 assists to help Miami rack up its 10th straight victory.

Mario Chalmers put in another 14 points and Chris Bosh added 13 as the Heat continued their dominance of the 76ers with their 12th consecutive triumph in the series.

The Sixers, meanwhile, dropped their fourth straight overall despite 21 points and six assists from Jrue Holiday.

Early wreck in Daytona 500 takes out favorites

DAYTONA BEACH, Fla. (AP) ? An early wreck in the Daytona 500 has knocked out several top contenders, including three-time NASCAR champion Tony Stewart and 2007 race winner Kevin Harvick.

Stewart, winless in 14 starts in The Great American Race, says he is "heartbroken and disappointed."

The nine-car wreck started when Kasey Kahne let off the gas to slow as they neared the first turn at Daytona International Speedway. Kyle Busch tried to do the same, but couldn't avoid contact.

Busch sent Kahne spinning across the track. Juan Pablo Montoya, 2010 race winner Jamie McMurray and defending series champion Brad Keselowski also were involved. So were Kurt Busch and Casey Mears.

The accident ended Harvick's attempt to become the first in NASCAR history to win the exhibition Sprint Unlimited, a twin qualifying race and the Daytona 500 in the same Speedweeks.

CONCACAF Under-20 Championship in Mexico continues today

Jamaica will continue their campaign toward World Cup qualification when the CONCACAF Under-20 Championship in Mexico continues today.

The young Reggae Boyz will face Panama in a Group ?C? top-of-the-table clash at 3:30 p.m. Jamaica time.

Both teams, who are on three points from a game, have already booked their spot in the quarterfinals and will now play for group honours.

In the second game at the venue, Group D teams Mexico and El Salvador will face off. Those teams are also through to the quarterfinals.

The CONCACAF Championship comprises four groups.

The top two teams from each group advance to the quarterfinals, the winners of which will progress to the competition's semifinals and qualify for the 2013 FIFA Under 20 World Cup in Turkey.

Did two American executives fake their deaths in Mexico?

The reporter in Mexico who described the purported death of two American executives with a crumbling business said they were likely not killed and he may have been "fed" the story.

Antonio Neri Johnston, a reporter for El Occidental newspaper in Guadalajara, Mexico, wrote a story on Feb. 11, describing that the bodies of Americans Michael Davies and Derald Johnston, identified as the CEO and CFO, respectively, of Southridge Enterprises in Dallas, had been discovered.

Johnston said a man who claimed to be a police officer in a remote village said two bodies were found in a river with documents showing their identities.

"The strange thing is, they called me, but also other colleagues," Johnston, who could not be reached for comment today, told Dallas ABC affiliate WFAA.

But Johnston said neither local police nor American authorities have evidence of a crime where the bodies were found, nor that the men have been reported missing or even that they existed in the first place.

"We were fed a story, and many of us ran with it," Johnston told The Dallas Morning News.

The Securities and Exchange Commission terminated the registration of Southridge Enterprises Inc. in 2011, noting that there were approximately 134 stock "holders of record." ABC News was not successful in attempts to contact an attorney and law firm once associated with the company, Carrillo Huettel LLP, in San Diego, Calif.

According to one of its press releases on its website, Southridge Minerals announced in November 2012 that it "hired new legal representation" but did not specify which law firm.

Southridge Mineral states that it was in the "development and acquisition of gold and silver mines in Mexico," but Bandera Gold, a competing company, said Southridge claimed to have business in places in Mexico where none existed.

Starting in early 2012, Southridge began issuing press releases indicating that it had surface rights to Cinco Minas in Jalisco, Mexico, something that caught the attention of Bandera Gold, a gold exploration company in Alberta, Canada, that said it has ownership of the land.

Bandera Gold has been in a legal dispute with its former joint venture partner since 2008 over a $5.6 million agreement to invest in Cinco Minas,

"[Southridge] was claiming a comprehensive drill program and they were intercepting bonanza grades -- all of which when we were acutely aware the site was dormant. It has not had activity since late 2007," said Stephen Roehrig, Bandera's CEO.

Concerned that Bandera Gold's shareholders might be confused by the conflicting information, Roehrig said he hired an independent security team to monitor the site and found no evidence of mining activity.

Roehrig told ABC News Bandera sent "cease and desist" letters to the address Southridge registered with the SEC. Those letters returned "undeliverable."

Linda Coker, the tenant relations manager at the Dallas office building of Southridge and Southridge Minerals, told the Dallas Morning News that Southridge does not lease space in the building, though she said the company may have had a temporary or virtual office operation there.

"We made efforts to try and communicate with them," Roehrig told ABC News. "There's never been evidence that he at all exists. All attempts to communicate with him ended up as a dead end."

The SEC suspended trading in Southridge stock after the company issued a statement claiming that it had a joint partnership in Mexico with Kinross Gold Corp. of Canada. Kinross told the SEC there was no such deal.

Miami receives notice of allegations

(AP) ? Miami has finally received its notice of allegations from the NCAA, a long-awaited document accuses the Hurricanes of a "lack of institutional control" within its athletic department.

The allegations arrived on Tuesday. The institutional-control charge is typically one of the most severe the NCAA can bring after an investigation of rules violations. The governing body for college athletics declined comment Tuesday, one day after revealing that it was erasing some elements of its case against Miami because the information was obtained in impermissible ways.

"We deeply regret any violations, but we have suffered enough," Miami President Donna Shalala said in a statement Tuesday night.

A person familiar with the situation told The Associated Press that several former members of Miami coaching staffs are named in the notice of allegations, including Missouri basketball coach Frank Haith, who was with the Hurricanes from 2004-11.

Next up: The sanctions phase, where Miami's penalties will be decided. The Hurricanes have already self-imposed several sanctions, including sitting out two bowl games and a conference football championship game. Shalala said Monday she believes those punishments should be enough.

This saga started in September 2010, when the university told the NCAA that convicted Ponzi scheme architect and former Miami booster Nevin Shapiro made allegations to the school against former players. Shapiro said he interacted mostly with football players and recruits, as well as a significantly smaller number of men's basketball players.

Shapiro is serving a 20-year prison term for masterminding a $930 million fraud scheme.

"Many of the charges brought forth are based on the word of a man who made a fortune by lying," Shalala wrote. "The NCAA enforcement staff acknowledged to the University that if Nevin Shapiro, a convicted con man, said something more than once, it considered the allegation 'corroborated' ? an argument which is both ludicrous and counter to legal practice"

Miami wants to get through the sanctions portion of the process as quickly as possible. But typically, it takes about three months for a hearing, and then can take several weeks ? if not months ? more for the penalties to be handed down. The sides coming to a settlement beforehand is another possibility.

Shalala said Miami will work diligently to prepare a response to the allegations within 90 days.

"We trust that the Committee on Infractions will provide the fairness and integrity missing during the investigative process," Shalala wrote.

Miami and the NCAA have gone back and forth on the wording of the notice of allegations for several weeks, and the long-awaited letter was nearly delivered last month. That's when the NCAA acknowledged that some mistakes were made by its own enforcement department. And that resulted in some allegations coming out of the letter.

It also led to yet another delay in the process, which many at Miami believe has dragged on for way too long.

"This cannot end quickly enough," Miami coach football Al Golden said earlier this month.

Within about six months of Miami originally bringing the information it had on Shapiro forward, an NCAA investigation was quietly underway, and the story became widely known in August 2011 after Shapiro provided Yahoo Sports with details of what he claimed to have given dozens of athletes, recruits and coaches over an eight-year period.

Among the gifts Shapiro alleged to provide: Memorabilia, cash amounts both large and small, dinners, strip-club trips, prostitutes, and even an abortion.

Shalala, however, labeled most of those alleged benefits as "sensationalized media accounts."

"Despite their efforts over two and a half years, the NCAA enforcement staff could not find evidence of prostitution, expensive cars for players, expensive dinners paid for by boosters, player bounty payments, rampant alcohol and drug use, or the alleged hundreds of thousands of dollars in cash and gifts given to student-athletes, as reported in the media," Shalala wrote. "The fabricated story played well ? the facts did not."

Several Miami football and men's basketball players have either served suspensions, paid restitution or both in the past two years after their involvement with Shapiro was discovered. Apparently upset with how people he thought were friends turned their back on him following his conviction for the Ponzi operation, Shapiro vowed that he would take down the program, and his attorney ? a Miami alum ? was willing to help the NCAA's cause.

Documents released Monday by the NCAA showed that Shapiro's attorney, Maria Elena Perez, offered to assist investigators working the Miami case by using subpoena power to depose witnesses under the guise of a bankruptcy case. NCAA enforcement officials accepted her offer, even feeding her questions to ask for at least one of the depositions, and records show they paid at least $19,000 for her work ? though she billed them for three times that much.

Perez did not respond to requests for comment Tuesday night. Shawn Eichorst, the Nebraska athletic director who held the same role at Miami for some of the NCAA probe, also declined comment. Texas Tech athletic director Kirby Hocutt, who was the AD at Miami for some of the time when Shapiro was a booster, did not respond to a request for comment.

Shalala also said former Miami athletic director Paul Dee, who held the job before Hocutt, also was not interviewed by the NCAA before his death in May 2012. Dee also was a member of the NCAA's committee on infractions, most notably when sanctions ? including a two-year bowl ban, scholarship reductions and vacating victories ? came down against Southern California in 2010, stemming from improper benefits given to then-Heisman Trophy winner Reggie Bush by sports marketers. Dee chaired the committee at the time, then saying "higher-profile players require higher-profile monitoring."

"The NCAA enforcement staff failed, even after repeated requests, to interview many essential witnesses of great integrity who could have provided first-hand testimony, including, unbelievably, Paul Dee, who has since passed away, but who served as Miami Athletic Director during many of the years that violations were alleged to have occurred," Shalala wrote. "How could a supposedly thorough and fair investigation not even include the Director of Athletics?"

Any allegations that came from the answers given in those depositions were taken out of the Miami case, the NCAA said on Monday when it unveiled the scope of its alliance with Perez and acknowledged that missteps were made. The NCAA's vice president of enforcement, who oversaw the Miami probe, has been ousted, and some investigators who worked the case are also no longer with the association.

That prompted Miami to lash out strongly at the NCAA on Monday, with Shalala saying "the lengthy and already flawed investigation has demonstrated a disappointing pattern of unprofessional and unethical behavior."

The NCAA declined comment Tuesday about Shalala's remarks, which included a demand that Miami not face any additional sanctions.

One of the ironies of the success of the Civil Rights Movement in Birmingham and elsewhere is that once the Jim Crow laws fell and African-Americans could live as fully enfranchised citizens, some of the institutions they had created under segregation began to crumble.

?Before Birmingham was integrated, we had our own neighborhoods, own entertainment districts and own business districts,? explained Hattie Barnes, the director of the city-funded Urban Impact. The non-profit agency was founded nearly 35 years ago to help revitalize black institutions, especially the Fourth Avenue Historic District where it has offices at 1701 4th Avenue North.

Once a thriving area that included restaurants, barber shops, churches, movie theaters and other businesses catering to African-Americans, the area (which includes 3rd, 4th and 5th Avenues and 15th through 18th Streets north) was once a hub for urban life.

?You could say it was the heart of black Birmingham in the ?40s, ?50s and into the ?60s,? Barnes said as she strolled down Fourth Avenue, waving and calling out to business owners up and down the street. ?But once African-Americans got their rights and could go and live just about anywhere they wanted, the area began a slow decline.?

In fact, by the time Richard Arrington, the city?s first black mayor, called Urban Impact in to help revitalize the area in 1980, there were fewer than 20 businesses still open.

?Now we?ve got well over 50 businesses up and running and more on the way,? Barnes said.

Urban Impact acts as a referral agency to federal, state and local governments and private organizations that have expertise in small business concerns.

Early on, the non-profit also helped establish a federal Land Bank Program designed to provide low interest loans to local people who wanted to establish businesses in the area and borrow money to improve existing enterprises.

?One of the problems we had was that much of the land and many of the buildings in the district were owned by absentee landlords who did not really see the profit in keeping businesses opened or their properties in good shape,? Barnes said. ?Now, every one of our businesses is locally owned and operated and a real sense of community is being reestablished,? she said as she popped into the Touch of Elegance Barber Shop on Fourth Avenue, where Sylvester Dawson waited for a customer to show up.

?I bought this shop four years ago and I?m still here,? he said with a grin as he lounged in one of his reclining chairs. ?This recession has hurt, but people always need a haircut and I am here to provide that service.?

As in the movies, Dawson?s establishment often serves as an informal town hall for the neighborhood, he said.

?Oh, people get to talking in here, all right,? he said. ?They take up every subject under the sun that men like to talk about and it sometimes gets loud in here until everybody has their say-so.?

The boundaries of the Fourth Avenue District include many black Birmingham cultural landmarks, including the old Carver Theater, now home to the Alabama Jazz Hall of Fame; Kelly Ingram Park, where so many civil rights marches of the ?60s originated; the adjoining Birmingham Civil Rights Institute; and the Sixteenth Street Baptist Church, where four little girls were killed a 1963 bombing that stirred the nation?s conscience.

The old Famous Theater Building on Fourth Avenue is one of the district?s best success stories, Barnes said. Several years ago, Nolanda Bearden, a local entrepreneur, renovated its ground floor into office space and turned the upper floors into a loft where she lives.

The A.G. Gaston Motel, founded by perhaps Birmingham?s wealthiest black businessman, was once a site of many civil rights planning sessions. Now owned by the city, the landmark still stands in the district, as do the Nelson Brothers? Caf? and the old black Masonic Temple.

But perhaps the most unique feature of the district lies at the corner of Fourth Avenue and 18th Street ? the Eddie Kendrick Memorial Park, named after one of the founding members of R&B superstars the Temptations.

The tiny park, which is almost hidden from the street by thick bushes and trees, features a full-sized iron statue of Birmingham native Kendrick, as well as bas-relief likenesses of four of the other Temptations.

Created about 15 years ago by Donald McDowell, a traveling artist who also has works on display in Kelly Ingram Park, the Kendrick park provides seclusion from the bustle of the city, as well as rest on a couple of wrought iron benches.

And if while sitting and contemplating Kendrick captured in full voice at the microphone, you begin to actually hear songs by the ?Tempting Temptations,? well, it?s not just your imagination.

?I guess you could say part of my job description is disc jockey, too,? Barnes laughed. ?We?ve got several CDs with nothing but Temptations music on them, and one of the first things I do when I get in the office in the morning is put one of them in the player and turn on the music down at the park.?

Mounted inconspicuously in the trees are speakers over which Temptations hits are played throughout the day. The wires from the speakers lead back to the Urban Impact offices a block away, where Barnes sees to it that the music rarely stops.

?I keep them going all day,? she said, ?and the last thing I do when I leave in the afternoon is put on another CD so the music continues for another hour or so. I think the park and the music is one of the things that helps define this street and the district.?

Obnoxious, but affective.

(Editor?s note: University of Kentucky officials stated this afternoon that Nerlens Noel will be out for the remained of the season with a torn ACL. Noel was considered a leading pick in the 2013 National Basketball Association draft before the injury.)

I was stunned this morning to pick up the Courier-Journal and read Adam Himmelsbach?s lead for the abysmal Kentucky-Florida basketball game.

The Wildcats? promising reemergence had completely come apart even before Nerlens Noel hit the backboard standard. The Cats were exposed finally as young, inconsistent, hesitant, confused, erratic and not particularly good.

Big Blue Nation, which hands over its heart to this group of youngsters every year for safekeeping, had to confront the fact that there will be no title, as in 2012, and not even an unexpected Final Four run, as in 2011.

We may even be back in Billy Gillispie territory.

And Himmelsbach?s story led with ? the Florida crowd?

?Florida fans in the O?Connell Center spent two hours yelling and roaring and making their arena shake as the Gators defeated the University of Kentucky 69-52 on Tuesday night. But with 8:03 left in the game, the cacophony was suddenly silenced.?

Not just him, by the way. Tom Leach, on Wildcat radio, and the unbearable Brad Nessler-Dick Vitale team on ESPN, both credited the Florida fans with politely applauding Nerlens as he was being carried from the floor.

Yes. Sportsmanlike. That?s the picture in the dictionary: People with orange and blue hair clapping their arms like alligator jaws.

Though that does beat a bunch of fools holding up their index fingers in ?we?re Number One? gestures as the camera zooms by.

Maybe, sometimes, you are Number One. But there?s only one Number One, so chances are your team is not it.

And, a side gripe: Who was the first TV sports producer who decided we fans sitting at home needed endless shots of the crowd to make our football, basketball and baseball viewing complete?

Right. The crowd?s where the action is. Although, to read Adam Himmelsbach?s lead, you might think that?s exactly true. (By the way, the rest of his article was pretty good ? worth reading.)

Well, this is the payback.

Calipari?s a genius recruiter, and last year he finally got his creds as a coach. But he?s not good enough to take a bunch of inexperienced 18-year-olds with lousy habits and turn them into a national contender year after year after year.

Last year, he promised us that Kyle Wiltjer would return with a bulked up body and more experience to be the veteran leader Miller ? and, before him, Deandre Liggins, Patrick Patterson and Ramon Harris ? had been.

Unfortunately, the veteran leader has turned out to be Jarrod Poulson. And while I love his story, and he seems like a terrific kid, the more minutes Jarrod Poulson plays on a regular basis, the more likely we?re headed for an 11th seed in the tourney.

The only freshman whose game, maturity, intensity and competitiveness were developing was Nerlens Noel. And when he was carried from the floor last night, so were Kentucky?s expectations for yet another wonderful season.

No wonder the Florida fans were respectful. They were enjoying the Wildcats suddenly going toothless.

If my face were painted orange and teal, I?d have been applauding, too.

Senators take up immigration in first hearing

WASHINGTON (AP) ? Senators are weighing one of President Barack Obama's second-term priorities at the first Senate hearing on a comprehensive immigration overhaul. Many stubborn fault lines are sure to emerge.

Wednesday's Senate Judiciary Committee hearing, which comes amid a concerted focus on immigration reform from the White House to Capitol Hill, was to feature testimony from Homeland Security Secretary Janet Napolitano and ? in an unusual move for Congress ? an illegal immigrant, Jose Antonio Vargas, a former journalist who founded the group Define American, which campaigns for immigration reform.

The former head of America Online, Steve Case, also was on the witness list, along with Chris Crane, president of the immigration and customs' workers union, which has opposed Obama's immigration policies.

The hearing comes a day after Obama, in his State of the Union address, renewed his call for sweeping immigration legislation that includes a pathway to citizenship for the nation's estimated 11 million illegal immigrants. Meanwhile, a bipartisan group of eight senators has been meeting to develop a bill by next month that accomplishes eventual citizenship for illegal immigrants while also containing enough border security and enforcement measures to gain conservative support.

The bipartisan Senate negotiators, including Sen. Chuck Schumer, D-N.Y., Marco Rubio, R-Fla., and John McCain, R-Ariz., are operating separately from the Senate Judiciary Committee, but the committee is expected to vote on any legislation they produce. In his opening statement for Wednesday's hearing, Judiciary Chairman Patrick Leahy, D-Vt., planned to emphasize the importance of a straightforward and attainable path to citizenship for illegal immigrants, including the youths known as "dreamers" brought here by their parents.

"Comprehensive immigration reform must include a fair and straightforward path to citizenship for those 'dreamers' and families who have made the United States their home ? the estimated 11 million undocumented people in the United States," Leahy's statement said. "I am troubled by any proposal that contains false promises in which citizenship is always over the next mountain. I want the pathway to be clear and the goal of citizenship attainable."

But with conservative lawmakers heavily represented on the panel, the hearing seemed likely to put into harsh perspective the difficulties of getting comprehensive legislation through Congress despite the commitment from Obama and many Republican leaders. A number of these leaders have come to view immigration legislation as a political imperative after November's election, when Latino voters flocked to Obama and helped ensure his re-election. But that view has not been embraced by all rank-and-file Republicans.

"The biggest obstacle we face to reform is this nation's failure to establish lawfulness in the system," a top committee Republican, Sen. Jeff Sessions, R-Ala., said after Obama's State of the Union speech Tuesday. "The president's plan meets the desire of businesses for low-wage foreign workers while doing nothing to protect struggling American workers."

In addition to border security and a pathway to citizenship for illegal immigrants already in the country, any comprehensive immigration legislation would probably address the issues of employer verification and temporary workers, and make changes to the legal immigration system. A major difference between Obama's proposals and the blueprint embraced by the bipartisan Senate negotiators is that the senators are making a pathway to citizenship conditional on border security being accomplished first ? something Republicans demand ? while Obama's plan contains no such linkage.

Vargas acknowledged his illegal status in a high-profile piece in The New York Times Magazine in June 2011 but thus far has avoided deportation. He was part of a Washington Post team that won a Pulitzer Prize in 2008 for coverage of the Virginia Tech massacre. He wrote in his Times essay that his mother sent him from the Philippines to live with grandparents in California in 1993 when he was 12. He wrote that he didn't find out he was in the country illegally until he applied for a driver's permit with forged documents.

I used to be on the verge of obese (6'2, 240), but I have lost 55 pounds in six months, from a combination of running, high levels of Vitamin D, and skipping meals.

I would like to focus on gaining muscle eventually. I gain muscle pretty easily. I'm wondering at what point one should switch from focusing on weight loss to muscle gain.

I currently have a BMI of 25. Since this is the upper range of "normal," should I switch focus now, or wait?

Ignore BMI

You have done wonderful to lose that much

We are the same height and I'm a lean, trim, 14 stone.

Body Fat is 10-15% and abs looks great.

Its time to get lifting.

I would recommend on starting to build muscle now, as the more lean muscle tissue you build, the more fat that will burn. And GOOD WORK losing that much weight that fast!

BMI is flawed math, and should be abandoned. By using BMI, I am "too fat" at age 45 and just under 6' tall and around 185 lbs. BUT.... My body fat is 4.8%, which is leaner than an olympic runner. If it says I'm "too fat" and there is so little fat that you can see veins on my abs, that's proof of BMI being a joke.

I've made quite a dramatic change in my overall physique (actually documented on these boards ^^), going from flat-out obese to now being quite buff, and from what I've gathered, there is no "right way" to do it. I am with Charles on this one, bodyweight exercises as well as moving iron is quite more benifitial to losing weight than any cardio workout. My approach was, to wrap it up in a metaphor "Tearing down the house and building a new one on a clean foundation". I went down to very low weight (on the edge of being underweight if you wanna bring in BMI), and build my physique up from there. While there's a little more to it than this, I'd like you to consider that losing tremendous amounts of bodyfast AND bulking up on muscle are two concepts mutually exclusive to one another. If you want to get your body to use its fat depots, you gotta stay below your daily energy requirement with what you eat. Whether you do that by increasing your requirement, eating less or a combination of the two is up to you. If you want to build muscle, you gotta eat at least your requirement. Afer all, where's the additional mass gonna come from if not from enough intake. Of course, you can become physically stronger, build good overall muscle and lose weight at the same time, no question, but for me, it worked tremendously to tackle these things one at a time.
If you are the type that definitely wants visible abs, you'll have an easier time doing it by losing bodyfat. They start to show around 12% bodyfat and get very visible at around 8 (this is where I am at the moment), and it is definitely easier to lose bodyfat than building up comparable amounts of muscle.
So, short answer to wether you should start now or wait: It depends on what you want. What are your overall goals?

In my case I wish I cut my bodyfat a tad more before starting lifting. I was at 17-20% bodyfat and 180lbs before starting lifting, and after was 195 at the same bodyfat. So now I'm 185 (last check) and trying to get down to 170 or so. I gained about 10lbs lean mass total, not really training for mass at all but central nervous system gains.

So here's your issue, assuming you were fat before, you probably had at least some muscle mass just from overfeeding, sumo wrestlers for example technically have some of the most "lean mass" out of all athletes, and they don't even lift. When you cut weight, especially doing it really fast, you lose muscle mass. So lifting is a good thing to do as part of a exercise program to prevent it.

What I'd say is do stuff fairly submaximal (maybe like 60% of 1rm on compound lifts) so the body doesn't have to take in a lot of calories to do the lifts. My experience it was really hard working in the "strength" rep range (like 1-3 reps) and trying to lose weight as I'd be so hungry all the time, and it's not good to use caffeine as a replacement for food. You'll see lots of powerlifters with high bodyfat because of this, it's easy to eat yourself into lifting more weight. So where P90x admittedly does decent is it gives you some light basically girl weight type stuff to do just to signal the body to keep the muscle mass. So basically, probably something like 10x3 or something on the compound lifts would be good to do, then when you're at a bodyfat you wanna be at, go for the lower reps per set/more weight option and eat a decent amount more. Once you're at a low bodyfat, it'll be easier to keep weight off as you'll teach your body to set itself at that point.

But yeah, basically the choice is gain muscle fast, gain fat also, lose fat fast, lose muscle also. At least this is my experience. So doing a little lifting would be basically the middle ground of these programs. Charles is right in that once you do have muscle mass, weight is easier to lose, as it burns more calories. You can also eat more and not worry as much with the muscle mass, as extra muscle mass increases your basal metabolic rate.
